Terms and Conditions

Please read these terms and conditions ("Terms of Use") carefully — they set out the basis on which you are allowed to use Swing. By downloading or using the app, these terms will automatically apply to you. The app itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to Swing.

Membership

To become a member you must be aged 18 years old or over and by login you confirm that you are aged 18 years old or over. You may terminate your membership at any time by sending an email to support [at] swing [dot] nz or clicking "Delete account" in settings on the mobile app.

Important: if you are a fee paying subscriber, you will also need to unsubscribe from Swing via your iTunes / App Store account to ensure your account is fully terminated.

When you delete your account, your profile, photos, matches, and chats are removed immediately. We retain your email and minimal technical data for up to 6 months for fraud prevention and legal compliance. To request immediate and complete deletion of all data, email support [at] swing [dot] nz.

Access to Swing

Access to Swing and any Content is permitted subject to your compliance with these Terms of Use and our Community Rules. You may only access Swing for individual, personal and non-commercial use. We may at any time restrict, suspend, or terminate your membership with immediate effect if we believe you may be in breach of these Terms.

Availability of Swing

Swing is available on a temporary basis. We update Swing regularly and may change the Content at any time. We reserve the right to withdraw or amend Swing without notice. We will never charge you for the app or its services without making it clear exactly what you're paying for.

Your Content / User Content

Swing enables you to upload your own content or take part in conversations. You take full responsibility for any of Your Content that you or we publish. You own the intellectual property rights in Your Content; however, you give Swing a limited licence to publish it so that Swing may provide the services effectively.

Community Rules

As a member you agree to: provide accurate information and keep it updated; use a legitimate Apple ID or email to sign up; not post content that is offensive, obscene, threatening, abusive, defamatory or otherwise unlawful; and use the services in a professional manner.

You agree not to: act dishonestly; misrepresent your identity; create a profile for anyone other than yourself; harass or abuse other users; send spam; scrape profiles; interfere with Swing or connected servers; or act in an unlawful manner.

Intellectual Property

Swing and the Content are protected by patents, copyright, database rights, trademarks and other intellectual property rights. You may only view, download, and use Swing for personal, non-commercial use with appropriate acknowledgment.

Your Liability to Us

You shall be responsible for all costs allowable by the Courts that we may be awarded as a result of your breach of these Terms of Use and/or your unauthorised use of Swing and/or the Content.

The Swing app stores and processes personal data that you have provided to us, in order to provide service. It's your responsibility to keep your phone and access to the app secure. We recommend that you do not jailbreak or root your phone.

Limitation of Liability

To the fullest extent permitted by applicable law, Swing and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of or inability to use the Service, any conduct or content of other users, or unauthorized access to your account. The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

Purchases

If you made a purchase using your Apple ID, refunds are handled by Apple, not Swing. To request a refund, go to the App Store, click on your Apple ID, select "Purchase history", find the transaction and hit "Report Problem". You can also submit a request at getsupport.apple.com.

Changes to These Terms

We may update our Terms and Conditions from time to time. You are advised to review this page periodically for any changes.
